“Crazy Heart”- a case of plagiarism?

Berkley, Cal. songwriter Paul Iorio saw the movie “Crazy Heart” a couple days ago and left the theater feeling ripped off. The movie was fine, but Iorio says he heard the melody of his 1989 composition “Is the Rushmore Bridge Falling Down” in the song “Fallin’ and Flyin’” written by Stephen Bruton and Gary Nicholson. The song is a prominent piece of Jeff “Bad Blake” Bridges’ repertoire.

Iorio said he hasn’t decided to seek legal action. In the meantime, you be the judge.

First, it’s a simple and generic melody. Don’t complain another song sounds like your generic song.

Second, how would they have even heard Paul Lorio’s song? Paul has never published or released anything listed on allmusic.com. I googled the song title with 0 results. I googled the album name with 0 results. I can’t even find a website for this Paul Lorio. How is it possible they heard his music to steal it? And why would they steal music that was never good enough to get officially released and or noticed by the public?

For starters, I’d suggest that Paul actually tune his guitar and play in time, just sayin’….
